The politically right-leaning social media platform, Parler, is being sued by a Florida Attorney after the company allegedly sent unsolicited text messages, violating Florida law.

TAMPA, Fla. – The social media platform, Parler, is being sued by a Florida Attorney after the company allegedly sent unsolicited text messages, violating Florida law.

According to the lawsuit filed by Tampa Attorney Dale Golden, Parler blasted a text message directing him to “check out” the app and its new features, including the ability to “reply to comments, emoji responses, notifications fixes & more.”

In a proposed class-action lawsuit, filed in Hillsborough County, Florida, Golden seeks damages against Parler for allegedly violating Florida’s Telephone Solicitation Act.

The lawsuit states that on or after July 1, 2021, Defendant (Parler) made, or knowingly allowed to be made, the following “telephonic sales call” as defined by Fla. Stat. § 501.059(1)(j) to Plaintiff’s Telephone
Number.

Based in Nashville, Tennessee, Parler says it is the solution to problems that have surfaced in recent years due to changes in Big Tech policy influenced by various special-interest groups.

“Parler is built upon a foundation of respect for privacy and personal data, free speech, free markets, and ethical, transparent corporate policy,” according to Parler’s website.

According to his bio, Golden is “an AV rated attorney whose practice focuses on the defense of professional liability and consumer law claims, including class actions. He is a nationally recognized authority on the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, and the Telephone Consumer Protection Act and a published writer on industry topics.” 

We have reached out to Benjamin W. Raslavich, Golden’s Attorney, for comment and to find out if Golden had a Parler account prior to the text message and how the company obtained his number.

We have also reached out to Parler for comment in this case and have yet to hear back, but again, will update this story if a comment is received.
