Punta Gorda, FL - A man's been arrested after waiving a gun in the air at boaters who sped thru his canal on the Fourth of July.

According to the Charlotte County Sheriff's Office, Dennis Fair waved the gun in the air and took a shot at boaters in the canal behind his Punta Gorda home on July 4th.

Witness Brett Cox tells NBC 2 News Fair was drunk when he stumbled out of his home with the gun in his hand and firing a shot after Cox travelled in the canal behind Fair's home.

Cox says Fair started waiving the gun around before he "popped one in the ground and goes 'come over here and I’ll show you what this thing can really do.'”

Cox and his passengers immediately dialed 911 after the shot was fired.

Deputies took the inebriated Fair in for questioning where he claimed Cox was speeding.

Cox says he's interacted with Fair in the past, and normally, his interactions were positive, telling NBC 2 News "he says nice boat or nice flag. He always yells something but it was always nice."

Fair is facing four counts of aggravated assault, plus using a firearm under the influence of alcohol.

Deputies took away Fair’s guns as part of the red flag law.
