According to the state, many Walgreens pharmacies across the state closed without notifying the public throughout the pandemic.

However, the Montpelier Walgreens pharmacy was closed on Friday, but they gave proper notice to the public.

"This caused a ripple effect of patients not being able to pick up their prescriptions or having the prescription billed to their insurance and then having to pay for the prescription out of pocket," said Lauren Hibbert, Director of the Office of Professional Regulation.

The state of Vermont's Office of Professional Regulation released a forty-page charging document against the national Walgreens pharmacy and specific locations across the state.

These charges are being brought to the Vermont Board of Pharmacy, requesting all 32 Walgreens pharmacies in the document have their licenses revoked, suspended, reprimanded, conditioned or otherwise disciplined.

"It's a wide variety of issues within the document," Hibbert said.

According to Hibbert, those issues span from unexpected closures without notifying patients, mainly back in 2020, to medication and vaccine errors.

But she said this isn't uncommon with retail pharmacies, especially since the pandemic.

"We advocated in front of the legislature for a change in the law to allow us to pursue discipline against a retail drug chain when there's a policy that the corporate pharmacy is putting forward that causes unsafe practices," Hibbert said.

Hibbert said the change was made in 2021, but this is the first use of the law.

"There's a range of possibilities, all the way from revocation to a reprimand. But, I can't speak to what the state is actually looking for," Hibbert said.

The Office of Professional Regulation hopes all retail pharmacies will take responsibility for how their corporate policies affect pharmacists and consumers across the state.

In 2020, the office conducted a survey on working conditions in pharmacies across the state.

"We found that pharmacists were often in a bind between what the chain was telling them to do and what their ethics were telling them to do and what their patients expected," Hibbert said.

Going forward, Hibbert said she hopes the law will radiate change throughout the industry, creating a safer environment for both employees and customers.
