APPLETON (WLUK) -- A sentencing in a co-sleeping death case was postponed amid an outpouring of support for the woman convicted.
Nicole Sobay, 36, was convicted of one count of neglecting a child with the consequence of death. Prosecutors said she had been sleeping in the same bed with her 2-month-old son in Appleton in 2017. She woke up to find the baby face-down and not responding.
Her blood tested positive for amphetamines, methamphetamines, opiates, and cannabinoids.
While Judge Mitchell Metropulos delayed the sentencing, he did hear testimony from a number of family members who asked for Sobay's release.
Her mother, Janice Halverson, testified that Sobay became addicted to painkillers after a serious car crash.
"She hadn't been using (drugs) for any extensive amount," Halverson said in court. "She was clean throughout her pregnancy, she was clean when the baby was born, and she made one slip-up."
Metropulos noted that a stack of letters described as one inch thick was filed with the court on Thursday. The defense asked that he take the time to read the letters before issuing a sentence.
The sentencing was rescheduled for Aug. 19.
