Investigators say the children had left their day care in the 700 block of east Kansas, and wondered into the back yard around the corner.

Officers went to the day care and observed the day care provider, Tracy Barr, 47, drive up with a child in her car.  The officers said she was driving under the influence and arrested her on suspicion of DUI, and suspicion of aggravated endangering a child.

The children were placed in protective custody and later released to their parents.  Barr is out of jail on bond.

Meanwhile, the Kansas Department of Health and Environment (KDHE), has issued an Emergency Order of Suspension to Golden Explorers, in McPherson. State law allows the Secretary of KDHE to issue such an order when, in the opinion of the Secretary, the order is necessary to protect children in the home from any potential threat to health or safety. The order is subject to appeal.
