Louisiana Supreme Court rules Ronald Gasser cannot be retried on murder charge
The Louisiana Supreme Court ruled Wednesday that the man accused of killing NFL player Joe McKnight cannot be retried for murder. Ronald Gasser was convicted of manslaughter in connection with the shooting death of McKnight back in 2016. Gasser was indicted on second-degree murder charges, but the jury in his first trial found him guilty of a lesser charge of manslaughter in a 10 to 2 vote. Gasser's manslaughter charge was overturned and he is awaiting a new trial due to Louisiana's new law that makes non-unanimous jury decisions unconstitutional. The Louisiana Supreme Court ruled that despite the manslaughter charge being overturned, the verdict was valid at the time it was rendered, and retrying Gasser on the murder charge would be considered double jeopardy.The ruling stated: "Defendant in the present case successfully appealed his unconstitutional nonunanimous conviction for manslaughter, and, as in Goodley, he cannot be penalized for seeking that appeal by being subjected to a second trial on a charge for which he has already been acquitted."A trial date has not been set for Gasser's manslaughter case at this time.
