ALBANY – A man who bit a state trooper on the leg following a traffic stop in Columbia County has lost his appeal to overturn his 5 ½-year state prison sentence.
Michael Worley alleged in his challenge in the Appellate Division of State Supreme Court that the sentence was unduly harsh or severe.
Worley, who pled guilty in county court in April 2019, was convicted of assault, obstructing governmental administration, criminal impersonation, and criminal mischief.
He was also sentenced to five years of post-release supervision.
“As a second violent felony offender convicted of a class D felony, defendant was subject to a determinate term of imprisonment ranging from five to seven years,” the appellate justices wrote in a June 23 decision. “Defendant received the agreed-upon prison term of 5 ½ years – only six months more than the minimum period of imprisonment that could have been imposed – and the record does not otherwise persuade us that corrective action in the interest of justice is warranted.”
