DEADLY CRASH THAT KILLED A EIGHT-YEAR-OLD LAST WEEK IN LEXINGTON APPEARED IN COURT TODAY. CHRISTINE: SIX DAYS AGO, POLICE SAY AMBER WHITAKER WAS DRIVING WHILE IMPAIRED WHEN SHE CRASHED INTO A NCDOT TRUCK. KENNY: FOUR KIDS WERE IN HER CAR, TWO WERE HER OWN. THE CHILD WHO WAS KILLED WAS NOT WHITAKER’S. WXII 12’S MARIA DEBONE JOINS US LIVE NOW OUTSIDE THE DAVIDSON COUNTY COURTHOUSE. MARIA. >> AMBER WHITAKER WAS ORIGINALLY ARRESTED FOR A DWI AND DRIVING WHILE HER LICENSE WAS REVOKED. SHE POSTED THAT BOND BUT AFTER FURTHER INVESTIGATION, POLICE SAY SHE WAS FOUND TO HAVE METHADONE IN HER SYSTEM AND WAS ARRESTED AGAIN. SHE REMAINS IN JAIL ON A $500,000 BOND. WHITAKER APPEARED IN FRONT OF A JUDGE FOR HER FIRST COURT APPEARANCE. THE JUDGE SAID SHE’S CHARGED WITH FELONY DEATH BY MOTOR VEHICLE AND FELONY SERIOUS INJURY. IF FOUND GUILTY ON ALL, SHE COULD FACE UP TO 33 YEARS IN PRISON. LEXINGTON POLICE SAY LAST TUESDAY, WHITAKER WAS DRIVING HER TWO KIDS, AGES THREE AND FOUR, AND TWO OTHERS, AGES 15 AND EIGHT. POLICE SAY SHE FAILED TO STOP FOR A NCDOT CREW PICKING UP DEBRIS ON THE SIDE OF THE ROAD AND CRASHED INTO THEIR TRUCK. EIGHT-YEAR-OLD JAYDEN SMITH WAS KILLED. THERE’S A GROWING MEMORIAL FOR JAYDEN AT THE SCENE OF THE PCRASH. ACCORDING TO FAMILY, WHITAKER’S THREE-YEAR-OLD DAUGHTER, GRACIE LANKFORD, IS IN THE HOSPITAL IN CRITICAL CONDITION WITH A SPINAL INJURY. POLICE SAY THE OTHER TWO CHILDREN ARE OK MEDICALLY.

The woman charged in the deadly Lexington crash that killed an 8-year-old last week appeared in court Monday. Amber Whitaker, 35, was originally arrested for a DWI and driving while her license was revoked. She posted that bond, but after further investigation, police said she was found to have methadone in her system and was arrested again. Lexington Police Department captain Luke Davis confirmed to WXII that Amber Whitaker, 35, was arrested Friday night. She was charged with felony death by motor vehicle and felony serious injury. If found guilty on all, she could face up to 33 years in prison.She is being held on a $500,000 secured bond.Lexington police say Whitaker was driving her 2 kids, ages 3 and 4 and 2 others, ages 15 and 8. Police say she failed to stop for an NCDOT crew picking up debris on the side of the road and crashed into their truck. 8-year-old Jayden Smith was killed.There’s a growing memorial for Jayden at the scene of the crash.According to family, Whitaker’s 3-year-old daughter, Gracie Lankford is in the hospital in critical condition with a spinal injury.Gracie's older sister started a GoFundMe for her.
