The Texas Supreme Court has paved the way for the high-speed train from Dallas to Houston.

In a 5-3 decision, the court ruled that Texas Central Railroad can use eminent domain to acquire land for the bullet train. The decision comes after a years-long dispute between Texas Central and Texans Against High-Speed Rail, a group concerned about the possible use of the eminent domain to seize land for the project. But Texas Central has said they will only use eminent domain as a last resort.

The project still faces obstacles. Earlier in June its CEO resigned and it still owes hundreds of thousands of dollars in property taxes to counties along its route.

The project has been in development for about a decade. Modeled on Japan’s bullet train, it promises Dallas to Houston in about 90 minutes.
