An act of littering led to a drug suspect’s felony arrest in Leesburg.

A police officer saw a man throw an object Wednesday from a black Dodge Charger into the yard of a residence located at 1112 Pioneer Trail in Leesburg. The officer had been traveling westbound on Seminole Trail when he saw the Charger pass him doing 40 miles per hour in a 25 mph zone. The officer observed the Charger turn onto Pioneer Trail where the Charger failed to stop at a stop sign. The officer saw the driver, later identified as 27-year-old  Kourtney Keymond Smith of Okahumpka, throw something out of the Charger’s driver’s side window. The officer was able to get a close look at the driver as he threw the object, according to the police report. The Charger was then driven into the backyard at 1112 Pioneer Trail.

The officer radioed for backup and recovered the items thrown from the Charger. A clear baggie containing marijuana and baggies containing 27 schedule II narcotics, a white crushed up substance which field tested as MDMA and a baggie containing what appeared to be THC oil were recovered.

Before the police could make contact with Smith, the homeowner came out and told the officers that someone had just parked in his backyard and that the driver had no right to be there.

When the officers reached Smith he was standing next to the car with the driver’s side door open. The officer noted in the arrest report that the Charger had “a strong odor of marijuana emanating from the vehicle.” When the officer searched Smith he found the key to the Charger in Smith’s right front pocket.

Smith was charged with possession of MDMA, possession of amphetamine and possession of marijuana. After processing at the Leesburg Police Department, he was taken to the Lake County Jail where bond was set at $5,000 which was posted early the next morning.
