Pair of life sentences handed down in Guadalupe County courtrooms


County Attorney’s Office applauds efforts to provide justice to the families

(Seguin) – Guadalupe County Attorney Dave Willborn says the message from his office of prosecutors has again been made clear. “Violent crime will not be tolerated in our county, and that taking someone’s life will get you thrown behind bars for the rest of yours.”

This message was yet again illustrated twice this past week at the Guadalupe County Justice Center.

After an almost two-week long jury trial, Willborn says a Guadalupe County jury found Brian Everett Day,44, guilty of Capital Murder for the slaying of Thomas, 29 and Jenita Holland, 27 on Dec. 21, 2017. Day was sentenced to serve life in prison without the possibility of parole by State District Judge William “Bill” Old.

The State of Texas was represented by both Willborn and Special Assistant Heather McMinn. Day, 44, reportedly shared a fence line with the married couple who was found dead inside their home located in the 2100 block of Vivroux Ranch Road.

In the same week, he says Bruce Lee Kittelson, 62, was sentenced to serve his life in prison for the 2018 murder of Rocky Weaver, 48 by State District Judge Jessica Crawford. The State of Texas was represented in that trial again by McMinn as well as ACA Patton Zarate. He says the trial for the Kittelson case took place in early May of this year, Kittelson was found guilty, and the sentencing occurred on Monday June 13, 2022. In September 2018, Kittelson shot Weaver and fled the home located in the 3100 block of Zion Hill Road. He was later found and arrested at a local grocery store.

Willborn credits the excellent work by the Guadalupe County Sheriff’s Office and the diligence of his office in ensuring that justice was done in each of these cases.

“In both of these cases, law enforcement took special care to do investigate the cases in precisely the right way, so that my office could bring the evidence to the citizens of Guadalupe County, and so that these murderers could be held accountable,” said Willborn.

Of special note were the efforts, patience, and assistance of the families of the victims in each case. Willborn states, “without the sheer toughness and bravery of the families involved in these cases, this could not have been done. At the most difficult time in their lives, these families stepped up and spoke out. I admire their courage and resilience.”

Willborn also thanked the jurors in both cases.

“The jurors in each of these cases are a shining example of people who take their civic duty seriously. They paid close attention to the facts presented to them and came to the right conclusion. The system cannot function without good people like them,” said Willborn.

Officials add that there are three more murder cases awaiting jury trial this year here in Guadalupe County. Willborn says his office will be working toward the same justice in each of those cases.
