State prosecutors are asking a judge to consider things like demographics and ease of travel if he decides to move the trial for one of the Fairfield teens accused of murdering Spanish teacher Nohema Graber.
Lawyers for Willard Miller asked Judge Shawn Showers to move his murder trial out of Jefferson County last week. The judge hinted he would likely grant any move due to pretrial publicity.
In a new filing Thursday, state prosecutors agree that a fair jury "cannot reasonably be selected in Jefferson County" and the trial would be better off if it moved to another Iowa county.
But the state says if it is moved, they want the court to consider a county with similar demographics as Jefferson County and a courthouse that is easily accessible. They also hope the court will consider a county that will be easy to travel for not only the state and defense but family members of the victim's family.
Miller and Jeremy Goodale are both facing murder charges in connection to Graber's disappearance and death last November. Her body was found in a park near Fairfield High School that she was known to take walks frequently.
Miller has a hearing this July over the evidence. Defense lawyers want the judge to suppress certain evidence in the case. A judge recently denied both suspects requests to move their cases to juvenile court.
Miller's trial is scheduled for November 1, 2022 and Goodale's trial is scheduled to begin August 23, 2022.
