A Douglas County judge is scheduled to hear the lawsuit on June 7.

Belcastro-Gonzalez wants the termination process stopped until her arbitration hearing. She was placed on leave in January.

The police captain previously sued the city in federal court, alleging her claim of sexual harassment was not fully investigated. That case is set to go to trial this fall.

Schmaderer said there's no merit to her allegations and requested her termination earlier in May.

Belcastro-Gonzalez's attorney, Tom White, said in January that they are very concerned that the captain being put on leave could "indicate further improper behavior." White said they'll be going forward with the lawsuit.

"There's a pending case alleging retaliation. There's been significant progress in that case and then suddenly this occurred. We're very concerned that it may indicate further improper behavior," White said.

Belcastro-Gonzalez is the wife of former Deputy Chief Greg Gonzalez. He retired from the Omaha Police Department in January and is running for Douglas County Sheriff.
