Newark, N.Y. - Four people have now been charged in the brutal attack of a teenager with autism.
Since they were taken into custody in the last few days, the suspects have been released on appearance tickets.
Sixteen-year-old Caleb Davenport was approached last Thursday near the Erie Canal by what appeared, at first, to be a group of friends.
Instead, he was beaten up and left unconscious, as evidenced by a video shared online. A bystander called 911 after finding Caleb on a trail in Newark not far from home. The teen had been brutally attacked.
"It has consumed every minute since the event. We have investigators in and out," said Shannon Davenport, Caleb's mom.
The Wayne County Sheriff's Office has since arrested four people in the case.
Thomas Eaves of Geneva and Jordan Dreschler of Newark, both 18, have been charged. Authorities have also arrested two juveniles, one from Rochester and another from Canandaigua.
According to police, Eaves and the two juveniles are accused of attacking Caleb while Dreschler filmed the incident on his cell phone.
The group is also accused of robbing the teen of his phone and shoes as he laid injured on the ground.
"It was very quick work from the sheriffs. We’re still trying to process the whole situation, how it happened, the people involved, the way it happened," said Shannon Davenport.
She says she has mixed emotions by the arrests. Nearly two weeks later, she says she's relieved the suspects were caught but is frustrated and worried they are back on the streets.
Davenport also says she's concerned the teens aren't facing more serious charges.
Despite questions raised over whether the incident was gang-related, Wayne County's sheriff says there is no evidence to support that.
Deputies are also asking anyone with information about any similar incidents to come forward.
While the family continues to process what happened, Caleb's mother says she is upset the suspects were merely ticketed and released.
"The way the law is written, the sheriffs basically have their hands tied with more charges on what they can do due to the seriousness of the crime, but this is going to have a long-lasting effect on my child’s mental state, so I’m definitely going to pursue some legal counseling because of this," said Davenport. "I will do everything I can to get justice for him."
The sheriff says one of the suspects, Eaves, posted bail and was arrested again for another assault incident in Newark and was issued an appearance ticket.
All suspects are due back in court soon. The sheriff says perhaps the most surprising element of this case, besides the attack itself, is the pushback from some relatives in holding the teens accountable.
