DA finds no criminal actions after looking into Tina Peters’ election fraud claims

MESA COUNTY, Colo. (KDVR) — Mesa County District Attorney Dan Rubinstein looked into an election report that was prepared for Mesa County Clerk Tina Peters’ legal team, which claimed it found evidence of “potentially unauthorized and illegal manipulation of tabulated vote data” for elections in 2020 and 2021.

The report, named Report #3, claims Colorado Secretary of State Jena Griswold was involved in deleting tens of thousands of voting records.

Rubinstein said there was no probable cause that a crime was committed, rebuking the report’s claims as “inaccurate” of what happened during the elections in question. The DA found extensive evidence that the conclusions in Report #3 were false.

The investigation found no evidence that indicated any outside interference with the election and found evidence that “specifically contradicted” that ballots could have been preloaded, as the report claimed.

The DA’s office was not able to extensively interview the authors of the report, as they referred the DA to Peters’ attorneys for comment. When the DA’s office talked to employees of the Mesa County Clerk that worked in the 2020 and 2021 elections, none indicated they had spoken to the report’s authors or had even heard of the report.

Griswold’s office provided the following statement:

“District Attorney Rubinstein’s findings confirm what we already knew, not one of these reports has shown any evidence that the results of the 2020 election or any other election were not accurate. These misleading reports only serve to further the spread of election disinformation. Colorado leads the nation in election security and will continue to do so through legislation like the Colorado Election Security Act which protects against officials, who serve in public trust, from jeopardizing the state’s election security from within to prove conspiracies.”

Peters has been arrested on conspiracy and misconduct charges and is being investigated by the FBI and Colorado state officials in an alleged breach of elections equipment in Mesa County in May 2021. A judge ruled she is barred from overseeing elections in Mesa County this year.

Peters will make an appearance on Colorado Point of View Sunday, May 22 at 7:30 a.m. on Colorado’s Own Channel 2.
