San Jose police arrest woman in alleged killing of boyfriend

SAN FRANCISCO (KCBS RADIO) – A 41-year-old woman is in custody after police alleged she shot her boyfriend in a home near the San Jose State University campus early Monday morning.

Jessica Garrison has been held without bail at the Elmwood Complex Women's Facility in Milpitas since the San Jose Police Department arrested her that same day, according to Santa Clara County Sheriff's Office records. Police said in a Tuesday press release that she was initially booked into the Santa Clara County Main Jail for homicide.

Garrison called police early Monday morning to report that a person had been shot in a home on the 400 block of South 10th Street. Officers arrived at 3:08 a.m., finding that Garrison and an unresponsive man had been shot. The man was pronounced dead at the scene.

The San Jose Police Department first tweeted on Monday morning that officers had responded to a double shooting, and that officers had not yet determined a motive nor identified a suspect. Nearly eight hours after officers were called, officials said the incident had "been upgraded to a homicide."

At some point after being transported to a nearby hospital for treatment of a "grazing gunshot wound," homicide detectives arrested her "without incident" on Monday. A spokesperson told KCBS Radio in an email that she was arrested at the hospital after she was cleared to be released.

Police provided no other details on Tuesday. A spokesperson declined to answer multiple questions from KCBS Radio, including where Garrison sustained the gunshot wound and what led investigators to determine she was the primary suspect. The spokesperson said additional information will be released in a statement of facts and as part of forthcoming court proceedings.

Garrison is due to be arraigned on Wednesday at noon, according to sheriff's office records.
