LAPEER COUNTY, MI – The Lapeer County Prosecutor’s Office has filed charges against a 40-year-old Sterling Heights man who authorities said illegally entered an Oregon Township home and physically assaulted the homeowner.

Mustaque Khan was arraigned late Monday, May 16, on one count of home invasion, multiple assault charges, multiple resisting and obstructing police charges and malicious destruction of property.

Khan, who pleaded not guilty to the charges during his arraignment in 71-A District Court, has since posted bond.

His charges stem from an incident in the early morning hours of Sunday, May 15. Lapeer County 911 around 2:30 a.m. dispatched deputies from the Lapeer County Sheriff’s Office to a disturbance on Lakeview Drive after a neighbor reported two men were yelling at each other across the street.

When deputies arrived, they found a 29-year-old Sterling Heights man bleeding from his head. He told deputies he had gotten into an argument with Khan, who then became aggressive after eating a marijuana edible while they were at a Lakeview Drive home they had recently purchased together.

During the argument, Khan is alleged to have thrown his cell phone at the other man, hitting him in the head. Khan then ran away, visiting a neighbor’s house.

The neighbors became aware someone was in their home when they heard Khan yelling while on their back porch. He entered the home through a sliding glass door and began knocking silverware and other items off the counter.

When the homeowners confronted Khan he is alleged to have pushed the man before fleeing from the home. The homeowner was uninjured.

Deputies confronted Khan in the roadway. He didn’t listen to the deputies’ verbal commands and removed his shirt and “assumed an aggressive stance toward deputies,” according to a news release.

Deputies tased Khan to get him into custody. He was then lodged in the Lapeer County Jail.

Khan is scheduled to appear in court again on May 27.
