Stone County man facing 5 felony charges, 2 separate incidents

A Stone County man has picked up 5 felony-charges after allegedly swinging an axe at a couple, threatening to hurt his daughter and most recently for drug paraphernalia.

Two separate incidents found 45-year-old Gary Duane Smith behind the bars of the Stone County Detention Center.

On the night of March 22, officers of the Mountain View Police Department responded to a 911 call of an active break-in along Park Avenue. Officers arrived at 9:03 to meet a visibly shaken male and female at the front door of the residence. Upon speaking to the female victim, she stated Smith was outside knocking on the doors of the residence, but she refused to let him in.

Smith allegedly then opened a window and climbed and through it, stating he wanted some of his clothing and some of his other belongings from the residence. The male victim confronted Smith who stated he had a friend outside who would “kick the male victim’s butt.” Smith exited the residence and the male victim locked the door behind him.

Smith allegedly then grabbed an axe and swung, making contact with the front door twice, leaving two deep gashes allegedly penetrating the door all the way through to the other side. Smith then kicked the door and allegedly broke the interior lock latch apparatus.

Once Smith forced entry into the residence, armed with the axe, he swung at the female victim allegedly in an attempt to strike at her. The male victim stepped into the altercation in an attempt to remove the blade from Smith. The male victim then backed into the hallway to impede on Smith’s range of motion where he then struck Smith 4 to 5 times.

Smith allegedly dropped the blade and fled the residence when the female victim’s daughter began to call her. The daughter stated after Smith left the victim’s residence, he began texting and calling the daughter, screaming, cursing and threatening her. Smith allegedly threatened the daughter and said she was going to be placed in DHS. He then threatened to kill himself along with threatening others.

On another occasion, May 1, a Stone County deputy patrolling an area near the intersection of Blue Sky Road observed a truck parked in the side yard of an address along Sawmill Road.
The deputy positively identified Gary Duane Smith near the truck and knew he had outstanding felony warrants out of the Mountain View Police Department, and currently on probation.

The deputy pulled into the driveway of the residence when he observed Smith throw a black backpack inside the truck and begin walking towards the woods. The deputy identified himself and advised Smith to stop walking. Smith was handcuffed and placed into the patrol car due to the active warrants.

The deputy began searching the backpack Smith had thrown in the truck and observed a .22 caliber pistol loaded with one round in the chamber and 9 more in the magazine as well as a sock containing a glass smoking device, commonly used to ingest methamphetamine, and a small baggie containing white residue, which later field-tested positive for methamphetamine.

Gary Duane Smith has been booked into the Stone County Detention Center based on the March incident on the following charges:

2 counts of aggravated assault, a class D felony;
Breaking or entering, a class D felony;
3 counts of terroristic threatening;
Violation of a no contact order; and as a habitual offender.

For the May incident Smith has been charged with:

Possession of firearms by a certain person, a class B felony and possession of drug paraphernalia, a class D felony.
