Westcliffe man accused of attempted murder waives right to preliminary hearing

Kevin Richard Woodard, 29, of Westcliffe appeared for a preliminary hearing Wednesday afternoon in district court.

Woodard’s attorney, Jake Lilly, communicated Woodard’s desire to waive all rights to the preliminary hearing in order to keep a plea deal and continue further discussions with Deputy District Attorney Liz Drake.

Magistrate Michael Meyrick accepted the motion and set a dispositional hearing for 9:30 a.m. June 13.

After being suspected of playing a role in a homicide May 2, 2021, in Pueblo and a shooting in Fremont County the next day, Woodard was arrested on May 3, 2021, by the Arapahoe County Sheriff's Office.

At about 9:30 a.m. May 3, Woodard was suspected of shooting Tate Tucker at a home on Churchill Street in Williamsburg, according to an arrest affidavit penned by Fremont County Sheriff's Detective Peter Rasmussen. Tucker sustained a single-gunshot wound to the chest. He was transported to the hospital, where he was treated and later released.

Woodard was charged with attempted murder in the second degree, a class 3 felony, in the Fremont County case. He is being charged as a habitual offender, which carries a maximum 48-year sentence in the Department of Corrections if convicted.
