Chad Daybell asks for change of venue in murder trial

Chad Daybell was in court Tuesday to ask for a change of venue in his murder trial.

He's charged in the death of his first wife, Tammy Daybell, and in the deaths Lori Vallow Daybell's children, JJ Vallow and Tylee Ryan.

Prosecutors have said they want to seek the death penalty.

Daybell's attorney, John Prior, asked for the trial to be moved from Fremont to Ada county in Idaho, arguing Daybell couldn't get a fair trial because of the pretrial publicity.

The prosecution wants the jury brought in from Ada County, saying it will be less costly, and Prior said the cost is not the primary consideration for where to hold the trial.

The prosecution focused on the expense as it called witnesses to compare the costs of the two options.

As the hearing wrapped up, Judge Steven Boyce commented on the state's argument that moving the trial would be too expensive. He said if the state is so concerned about money, they shouldn't have filed for the death penalty, which is always expensive.

Boyce said he would take Daybell's request under consideration.

Lori Vallow Daybell will be appearing for an arraignment later Tuesday.
