NOTICE OF HEARING VILLAGE OF LISLE BACKUP SPECIAL SERVICE AREA NO. 1 NOTICE IS HEREBY GIVEN that on the 20th day of May, 2024, at 7:00 p.m., in in the Village Hall Board Room, 925 Burlington Avenue, Lisle, Illinois, a hearing will be held by the Mayor and Village Board to consider forming a Special Service Area consisting of the following described territory: PARCEL 1: THAT PART OF LOT 1 LYING WEST OF THE CENTER LINE OF THE EAST BRANCH OF THE DUPAGE RIVER OF WOODLANE ASSESSMENT PLAT NUMBER 2 OF PART OF THE SOUTHWEST ¼ OF SECTION 14 AND PART OF THE SOUTHEAST ¼ OF SECTION 15 AND PART OF THE NORTHEAST ¼ OF SECTION 22, ALL IN TOWNSHIP 38 NORTH, RANGE 10, EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED OCTOBER 28, 1982 AS DOCUMENT NO. The above parcels being commonly known as 1195 Summerhill Drive and identified by permanent index numbers 08-15-400-005; 08-15-400-006; and 08-22-100-013 in the Village of Lisle, DuPage County, Illinois. The approximate street/subdivision location is the area bounded by the Seven Bridges Golf Club on the south, DuPage River on the east, Seven Bridges Golf Club on west and Four Lakes on the north. A map of the proposed area is appended hereto and is on file in the Office of the Village Clerk, 925 Burlington Avenue, Lisle, Illinois, and available for public inspection. All interested persons, including all persons owning taxable real property located within Backup Special Service Area No. 1, will be given an opportunity to be heard regarding the formation of and the boundaries of the Special Service Area and may object to the formation of the Area, and the levy of taxes affecting said Area. The purpose of the formation of the Village of Lisle Backup Special Service Area No. 1 is to provide special municipal service to the Area, including, but not limited to, municipal services in connection with the (1) the repair, maintenance, replacement, removal, and renewal of the stormwater facilities (2) the repair, maintenance, replacement, removal, and renewal of common areas (3) the repair, maintenance, replacement, removal, and renewal of parkways that have been assigned to the homeowners association (4) including, but not limited to the repair, maintenance, replacement, removal, and renewal of all landscaping, inlets, outlets, and any other appurtenant structures associated with the stormwater facilities, common areas, or assigned parkways (4) such administrative costs incurred by the Village in connection with the above service, including, but not limited to, attorney's fees and insurance premiums for liability insurance coverage. It is the specific intent of the Village of Lisle and the fee title owner of the stormwater facility that the fee title owner, to-wit; Pulte Home Company, LLC. its successors and assigns, to be responsible for the repair, maintenance and renewal of the stormwater facility, common areas and parkways that have been assigned to the homeowners association, including, but not limited to the care, maintenance and replacement of all landscaping, inlets and outlets and any other appurtenant structures associated with the common areas, stormwater facilities, or assigned parkways. Further, it is proposed that in the event, after due notice of any deficiencies by the Village of Lisle, that the fee title owner fails to repair, maintain or renew stormwater facilities in accordance with applicable laws, ordinances and regulations concerning stormwater, or repair, maintain or renew common areas or assigned parkways, the Village of Lisle shall be entitled to levy such special service area taxes to cause the remediation of such deficiencies and maintain the stormwater facility. The fee title owner of the real property upon which the stormwater facility is located has conveyed to the Village of Lisle an easement for ingress and egress to the stormwater facility area as well as for an easement for the care, maintenance, repair and renewal of the stormwater facility in the eventthat the fee title owner fails to repair, maintain or renew the stormwater facility. A special tax will be considered at the public hearing to be levied for an indefinite period and not to exceed an annual rate of three percent (3% being $3.00 per $100) of assessed value, as equalized, to be levied against the real property included in the special service area. The proposed amount of the tax levy for special services for the initial year for which taxes will be levied is $25,000.00 but will not exceed the annual maximum rate of 3% of the assessed value, as equalized of the real property included in the special service area. At the hearing, all interested persons affected by the formation of such Special Service Area, including all persons owning taxable real estate therein, will be given an opportunity to be heard. The hearing may be adjourned by the Village Board to another date without further notice other than a motion to be entered upon the minutes of its meeting fixing the time and place of its adjournment. If a petition signed by at least fifty-one (51%) percent of the electors residing within the proposed Backup Special Service Area No. 1 and by at least five-one (51%) of the owners of record of the land included within the boundaries of the Backup Special Service Area No. 1 is filed with the Village Clerk within sixty (60) days following the final adjournment of the public hearing objecting to the creation of the Backup Special Service Area No. 1, then no such area may be established or enlarged, or tax levied or imposed.
