THE DISTRICT ATTORNEY WROTE IN A LETTER TO MARK DUBOIS THAT IN LIGHT OF THE CONSISTENT NARRATIVE EVENTS EMERGING FROM LAW ENFORCEMENT INTERVIEWS, VIDEO FOOTAGE, RECORDINGSND A CIVILIAN WITNESSES, I FOUND THAT THE USE OF FORCE WHILE DISCHARGING THEIR WEAPONS WHEN FIRED UPON WAS OBJECTIVELY REASONABLE AND JUSTIFIED. Braintree officers have been cleared in a June ambush that left a suspect and a police K9 dead, according to the Norfolk County District Attorney."He is riding super dirty. He has two illegal weapons in his bag, I believe," a caller reporting a domestic incident told 911.The call prompted officers to search for suspect Andrew Homen in the woods behind an apartment complex. Within minutes, one of the weapons that the caller warned about would be fired upon police."Two officers hit. K9 hit. Expedite," an officer could be heard radioing to dispatch in newly released audio recordings from the day. "Two officers, hit multiple times, I need blood control.” Officers returned fire. When it was over, three officers were injured, K9 Kitt was dead, as was the suspect. “The bleeding is controlled in our officers, (the) suspect is down, he's in custody," an officer said on the dispatch tape.Norfolk County District Attorney Michael Morrisey released a report Wednesday clearing the officers. "In light of the consistent narrative events emerging from law enforcement interviews, video footage, recordings, and civilian witnesses, I find that that three Braintree Police Officers' use of force while discharging their weapons when fired upon in Braintree on June 4, 2021 was objectively reasonable and justified,” Morrissey wrote in a letter to Braintree police Chief Mark Dubois. “They were fired upon – as you'll see in the report – a minimum of seven shots, and I think we accounted for every one of those shots hitting something, one of the officers or the dog," Dubois said. Braintree police said the district attorney’s decision is a relief to the injured officers, and the Department, as the healing process continues. "We figured this was going to be the outcome. Nothing is ever straightforward, but our guys were attacked violently, and they responded appropriately," said Braintree police Deputy Chief Tim Cohoon.Dubois said the district attorney’s decision is a relief to the injured officers, who continue to heal. "They're significant injuries. All three of them have very serious injuries. Two officers have surgeries scheduled still – in the next month or so,” he said. “There's a long recovery, one of them was told up to two years."
