On Wednesday, the planning board will hear a request to rezone the area on 38th and Dodge where three occupied multifamily homes sit.
The request comes after Skylark L.L.C. is seeking approval to build a 113 unit modern apartment building that includes a gym, a parking garage and retail shops.
The building is expected to cost $22 million and if it is approved it with replace the three apartments buildings currently there.
The rezoning request is more about the land than the building itself according to Martin Shukert the former planning director of Omaha.
“Rezoning or not does not have an impact on whether they can knock the building down or not it has to do with what use the land is put to.”
The current design for the building does not meet the current zoning regulations. Developers are asking for the regulations to be changed.
“Every property in the city and its jurisdiction has a zoning category and that category governs what the land in it can be used for---how dense a project can be how many units per acre or what the minimum lot sizes are the set backs requirements how far its set back from the street or from adjacent property lines there are a whole set of regulations that apply to each individual zoning district” said Shukert.
This decision is big and if the rezoning request is approved the development will then make its way in front of city council.
If the building is approved by city council the dozens of renters in the current buildings could be asked to leave.
According to Shukert the company who owns the houses are required to give the renters some type of notice.
