ELMIRA, N.Y. (WHCU) – An Elmira man facing attempted murder charges has been released after a witness refused to testify. 

36-year-old Elliot Barner was facing three counts of attempted murder in the second degree after allegedly firing multiple shots at a parked vehicle with people inside it. 

WENY reports after his arrest, the witnesses and victims refused to testify in a preliminary hearing, leading to charges being dismissed against Barner.

He’s been released from prison.
