A 42-year-old Stafford man was charged with driving under the influence after a pedestrian was struck and killed along River Road Sunday afternoon.
It's Jason Payne's third DUI offense in 10 years. Payne was also charged with involuntary manslaughter, failure to yield to a pedestrian and not wearing a seatbelt.
A Stafford County deputy was flagged down by a motorist at Kings Highway and River Road around 3:24 p.m. after a pedestrian was hit.
Deputy S.C. Jett saw an unconscious man in a ditch and radioed for more help.
Investigators learned 24-year-old Mohamed Hussein, also of Stafford, was using the crosswalk to walk across River Road near Pratt Park when he was struck by a Ford truck. Hussein was taken to an area hospital with life-threatening injuries and he passed away later Sunday.
Payne stayed on scene and deputies on scene reported smelling a strong odor of alcohol on his breath. A field sobriety test was administered and Payne was arrested.
He's being held without bond at the Rappahannock Regional Jail.
"Our thoughts and prayers are with the family and friends of Mr. Hussein." Stafford County Sheriff's Office said in a release.
