Worthington man faces two felony sexual conduct charges

WORTHINGTON — A Worthington man faces two felony counts of third-degree criminal sexual conduct, penetration, in Nobles County Fifth District Court following an Oct. 10 investigation by the Worthington Police Department.

Luis Roberto Pacheco Jr., 24, was arrested following a report that he sexually assaulted a victim classified as mentally impaired, mentally incapacitated or physically helpless.

According to the criminal complaint, a 19-year-old victim reported a sexual assault by Pacheco occurred at a party at Pacheco’s apartment in Worthington . The victim reportedly stated all of the individuals had consumed alcohol and were intoxicated.

The victim stated she stopped drinking alcohol between midnight and 1 a.m. on Oct. 10, and vomited several times before passing out in a bedroom. She awoke between 3 and 4 a.m. to Pacheco allegedly sexually assaulting her.

During an interview with police, Pacheco reportedly stated that he did not remember having sexual intercourse with the victim or anyone else. Pacheco agreed to provide a DNA sample.

If convicted, Pacheco faces up to 15 years imprisonment and/or a $30,000 fine on each of the two charges.
