GRAFTON, W.Va. (WV News) — The suspect in the June homicide of 26-year-old Tyler McKenzie Poston now is accused of trying to set Poston’s home aflame about five months prior to the slaying.

The West Virginia Office of the State Fire Marshal charged Joshua Blake Price, 30, of Farmington, with first-degree arson in the Jan. 12 burning of a cut up tire with paper placed on it under the front porch of Poston’s home.

The criminal complaint points to a custody dispute as a potential motive. The investigator, Ronald “Mackey” Ayersman, also cited call data with location information that placed Price’s person cellphone near the scene of the fire shortly before its discovery.

Price already is facing a felony murder charge in the death of Poston.

Poston’s body was found June 26 near his pickup at a pullout on U.S. 119 north of Grafton. He had been shot six times by a small-caliber weapon, according to an autopsy.

Taylor Prosecutor John Bord likely will present the Price murder charge case to grand jurors in January.

— Chad Michael Perkins, 34, has pleaded guilty before U.S. Magistrate Judge Michael John Aloi to unlawful possession of ammunition.

On Aug. 21, Perkins possessed 41 rounds of .22-caliber ammunition in an AR conversion drum magazine, the government alleged.

Perkins has a prior felony drug conviction and a burglary conviction, both out of Harrison County.

— Dustin Cain Anderson, 27, of Clarksburg, has been sentenced to 2 years in prison by U.S. District Judge Thomas S. Kleeh for unlawful possession of a firearm, according to the Office of U.S. Attorney William J. Ihlenfeld II.

Anderson had a .22-caliber revolver last November in Upshur County.

Assistant U.S. Attorney Christopher Bauer prosecuted. The ATF and Upshur Sheriff’s Office prosecuted.

— Shawn Fillmore Hyde, 47, of Clarksburg, has been charged with second-offense failure to comply with the state’s sex offender registry by State Police Trooper Anthony Petrella.

Hyde didn’t meet the deadline for registering an employment address, Petrella alleged.

— Harrison Circuit Judge James A. Matish on Friday granted the state’s motion to continue the trial of Katrina Price Barker, 29, of Clarksburg, on a felony child neglect charge.

Deputy Defender Perry Jones didn’t object to the request from Assistant Prosecutor Brian Shockley, which came due to late-developing potential evidence. Jones’ client is free on bail.

Matish set trial for Barker for Feb. 7.

— Wayne Timothy Woods III, 22, of Aliquippa, Pennsylvania, has pleaded guilty to delivery of less than a gram of fentanyl and will be sentenced Dec. 9 by Matish.

Woods could face a prison term of 2-10 years.

Assistant Prosecutor Brad Pustolski will make no sentencing recommendation as part of the plea agreement. Deputy Defender Jones can request an alternative.

The Greater Harrison Drug & Violent Crimes Task Force investigated.

— Joseph Buck Thompson, 35, of Clarksburg, has been charged with felony possession of a stolen vehicle by State Police Sgt. K.H. Totten III.

On Thursday in Harrison County, Thompson was operating a Mitsubishi Outlander that had been reported stolen, Totten alleged.

Separately, Clarksburg Patrol Officer Jacob Carter charged Thompson in the alleged theft of the Outlander on Oct. 5 in the city.

Harrison Magistrate Frank DeMarco held the initial appearance.

— Kenneth Lee Kemper, 36, of Bridgeport, waived his probable cause hearing before Harrison Magistrate Warren “Gizzy” Davis on a grand larceny charge, according to Chief Assistant Prosecutor Laura Pickens of the Office of Harrison Prosecutor Rachel Romano.

— Linda Lou Sutton, 52, of Clarksburg, has been probated 2 years and ordered to pay $200 restitution to The Kroger Co. after pleading guilty to forgery.

Judge Matish imposed the sentence Friday after Assistant Prosecutor Gina Renzelli and defense attorney Julie Garvin joined in requesting the alternative sentence.

Sutton said she forged a check because she wanted something to eat. “I was cold and homeless,” she said.

Statements in court indicated she has made positive strides in her life since then.
