BURKE — A Burke man is facing multiple serious felonies after he was indicted in Gregory County for allegedly raping a minor.
Todd Kemp, 57, of Burke, was indicted by a grand jury on Friday on third-degree rape, fourth-degree rape, sexual contact with a person under 16 and aggravated incest.
The indictment alleges that between Sept. 28, 2017, and Sept 28, 2018, Kemp raped a child who was under the age of 16 at the time.
After Kemp was indicted, an arrest warrant was issued the same day. He is currently being held in a jail without bond.
Kemp is a registered sex offender who served a nine-year sentence for the rape of a 10-year-old. He was convicted in Tripp County in 1990.

Third-degree rape, a Class 2 felony, is defined as the rape of an individual who is incapable to give consent due to their mental or physical capacity. Fourth-degree rape, a Class 3 felony, is defined as the rape of an individual under the age of 16.
If convicted on all charges, Kemp would face a maximum sentence of 70 years in prison, an $80,000 fine or both. Aggravating factors, such as prior convictions, are considered by a judge in the sentencing phase of a potential conviction.
Kemp is set to be arraigned in a Gregory County Courtroom on Oct. 6.
