'There is no mask mandate in St. Louis County': Missouri AG announces victory in lawsuit

ST. LOUIS COUNTY (KMOX) - Missouri Attorney General Eric Schmitt is claiming another victory in his lawsuit filed against St. Louis County over a face mask mandate.

St. Louis County Circuit Court judge Nellie Ribaudo denied the motion by St. Louis County Executive Dr. Sam Page to have the lawsuit dismissed. The judge also denied the motion to dissolve the preliminary injunction and a motion to stay discovery.

Schmitt sued St. Louis County over its mask mandate issued by Page in July.

“The people of St. Louis County scored another win as the Court denied the County’s motions to dismiss our case and dissolve the Preliminary Injunction, which remains in place,” said Attorney General Schmitt. “There is no mask mandate in St. Louis County, and I will continue to lead this important fight on behalf of the people of Missouri.”

Page issued the mandate on July 26 that required anyone at least 5-years-old to wear masks in indoor public places and on public transportation.

But the following day it was voted down by the County Council in a 5-2 vote. They said a new state gave them power to overrule Page and that he should have come to them before instituting the mandate.

After some public confusion on if a mask mandate was truly in place, Schmitt filed a lawsuit. Judge Ribaudo then issued an injunction and blocked the county from enforcing a mask mandate on Aug. 19.

There's a hearing on the lawsuit set for Oct. 18 at 10 a.m.
