DA: Worcester officer acted ‘reasonably, lawfully’ under circumstances that led to fatal shooting

WORCESTER, Mass. — An investigation into the fatal shooting of a man in Worcester by police in April shows the officer acted “reasonably and lawfully” and no charges will be filed, according to Worcester County District Attorney Joseph Early.

An investigation was launched into the fatal shooting of Phet Gouvonvong on April 21.

Gouvonvong was seen wearing large black backpack, which investigators said was consistent with his own description of having 50 lbs of explosives, wires consistent with a detonator and was armed with at least an AR-15 assault rifle, according to the investigation.

According to the investigation, Worcester police tried to convince Gouvonvong to surrender after he said he would bring a bomb to the Worcester Police Department.

After nearly an hour and a half of negotiations, after Gouvonvong refused to surrender, disarm or comply, he attempted to leave the area toward a gas station with fuel pumps, Gouvonvong was fatally shot by Worcester police officer Paul Cyr, according to the investigation findings.

“Under the circumstances, the Police Officer acted reasonably and lawfully,” Early said in the report. “Therefore, no criminal charges are warranted.”

Early said that during the investigation 911 calls, witness statements, police reports, crime scene photos, surveillance and cell phone video, autopsy reports and Gouvonvong’s firearm history were all reviewed.
