Genesee County, N.Y. —
A Batavia man accused of overdosing in front of a child is facing criminal charges.

Genesee County Sheriff's deputies say Kyle Hawley, 31, overdosed on an opioid in the presence of a person under the age of 17 just after 3:30 a.m. on Aug. 26.
He was given Narcan by emergency responders, taken to a hospital for treatment, and later released.

He was charged with endangering the welfare of a child and arraigned at the Genesee County Jail. He was released on an appearance ticket and will appear in Bergen Town Court at a later date.
