CLEVELAND -- On Jan. 1, 2009, Bay Area Rapid Transit officers responded to reports of a fight on an Oakland, California subway. They detained about 20 passengers. One of them, whom witnesses said was not involved in the fighting, was Oscar Grant. Oscar approached the officers and was immediately backed against a wall. Two officers then pinned Oscar, face down, on the pavement. A third officer, Johannes Mehserle, then drew his firearm and shot Oscar in the back. Oscar later died. The shooting was captured on cellphone video. Officer Mehserle claimed that he mistook his pistol for his stun gun.
