McKINNEY, Texas — Narciso Garcia, Jr., a 33-year-old resident of McKinney, Texas, has been sentenced to 40 years in prison for Assault of a Peace Officer after being found guilty by a jury, announced District Attorney Greg Willis.

"This repeat offender has repeatedly demonstrated that neither officers nor citizens are safe around him. Our community and law enforcement partners are safer with him off our streets for an extended period," stated Willis following the sentencing.

The incident occurred on July 29, 2020, when McKinney Police Department officers responded to a disturbance at the McKinney Express gas station on McDonald Street involving an individual later identified as Narciso Garcia. Officers Justin Blair and Teresa Lynch were dispatched to address the situation and encountered Garcia, who was determined to have an active parole violation warrant.

During the arrest attempt, Garcia resisted officers' commands, refusing to cooperate and even lifting Officer Blair off the ground. Despite the deployment of a taser to gain compliance, Garcia bit down on Officer Blair's wrist, causing injury and swelling.

The jury subsequently found Garcia guilty of the charges.

During the sentencing phase, prosecutors presented extensive evidence of Garcia's criminal history, which included prior incidents involving resistance and physical assault against law enforcement officers. A total of 21 prior adjudications and convictions were presented, including offenses such as assault family violence, resisting arrest, evading arrest, burglary of a building, unauthorized use of a motor vehicle, possession of a controlled substance, and theft.

Garcia had previously served two prison sentences—one in 2010 for fraudulent use of identifying information, resulting in a 7-year term, and another in 2017 for possession of a controlled substance, resulting in a 9-year term. At the time of this offense, Garcia was on parole for the possession charge after being released in July 2019.

Judge Jennifer Edgeworth presided over the case and sentenced Garcia to 40 years in prison.
