Jordan Neely's family suing Daniel Penny for wrongful death

NEW YORK (1010 WINS) — The family of Jordan Neely, the 30-year-old homeless man who was allegedly choked to death on a Manhattan train earlier this month, is planning to file a wrongful death lawsuit against Daniel Penny.

Penny, 24, put Neely, a Michael Jackson impersonator who was acting erratically, in a chokehold until he lost consciousness on May 1. New York medical examiners confirmed that Neely died from compression of the neck and deemed his death a homicide.

Neely was yelling at riders that he didn't have any food when he was attacked, but he had not assaulted anyone, according to witnesses.

Penny now faces charges for manslaughter.

Lawyers for Neely’s aunt notified Penny’s attorneys of the family’s intention to sue, the New York Post first reported.
