A Las Cruces man was arrested and accused of raping a 13-year-old girl.
Officers arrested 43-year-old Jesus Jose Rodriguez.
On April 30th, officers were called out to a call regarding a sexual offense against a teen.
The victim reported that Rodriguez had raped her.
The teen told investigators that Rodriguez threatened her if she told anyone about the incident.
The victim told investigators that a few days before Easter she was by herself in her room watching TV.
The victim fell asleep and woke up hearing Rodriguez and another man gaining entry into the home and could hear them talking in the kitchen.
The victim said Rodriguez went into her room and could hear the other man going through everything in the house as Rodriguez was in her room.
The victim stated that Rodriguez grabbed her and threw her on the bed and asked her to take off her clothes.
The victim said she refused.
The teen told Rodriguez no several times, according to the court document.
Rodriguez then struck the teen in the face with his hand and removed her clothes, according to the arrest affidavit.
The 13-year-old stated he received two black eyes as a result.
Rodriguez then removed his own pants and underwear and sexually assaulted the teen, the affidavit stated.
The victim stated she continued to tell him no and tried to fight him off.
Rodriguez threatened her by saying "If you tell anyone, I'll kill you and your whole family," according to the arrest affidavit.
Rodriguez is charged with kidnapping, aggravated residential burglary, failure to appear, criminal sexual penetration, and assault with intent to commit a violent felony.
Rodriguez is currently being held at the Doña Ana County Jail without bond.
