Kerhonkson man arraigned in Ulster County murder case

ULSTER COUNTY, N.Y. ( NEWS10 ) — A Kerhonkson man has been arraigned on an indictment connected to a recent homicide in the town of Rochester, according to the Ulster County District Attorney’s Office. Damon Foy, 50, was arrested on April 3 .

The indictment alleged that between March 31 and April 1, Foy murdered Alberta Dale, 44, of Pennsylvania, reportedly dismembered her, and was attempting to dispose of her body when police intervened. Dale’s remains were located on April 3 following an investigation into her disappearance.

The investigation determined that foul play was possible in Dale’s disappearance, and evidence was uncovered that led to the issuing of search warrants for Foy’s home. Upon searching Foy’s residence, additional evidence was located, and Foy was taken into custody. The indictment charged Foy with the following crimes:

Charges

  • Second-degree murder
  • Aggravated criminal contempt
  • Concealment of a human corpse
  • First-degree criminal contempt
  • Third-degree criminal mischief
  • Third-degree assault
  • Criminal obstruction of breathing or blood circulation
  • Fourth-degree criminal possession of a weapon

Ulster County Sheriff Juan Figueroa issued a statement on the arraignment, saying “This was an example of total disregard for human life. What happened to the victim was horrific and cruel and will not be tolerated in our community; the Ulster County District Attorney’s Office, Ulster County Sheriff’s Office and the New York State Police we will fight for justice for the victim and her family.”

“This case showcases in one person the evil of domestic violence. Let there be no speculation about mental health, as often happens – this was a pure exhibition of evil,” said District Attorney Emmanuel C. Nneji. “The total disregard for the life and dignity of another person is at the heart of domestic violence; Damon Foy has shown us that. As we prosecute this case and pay our respects to Alberta Dale, we must recognize in our laws the rights of victims to be actually safe from their main source of the danger targeted for them, and demand laws that actually protect victims.”

Following his arrest, Foy was remanded to the Ulster County Jail without bail, where he has remained since. He is scheduled to return to court at a later date.
