After many delays and trips to State Superior Court for some additional rulings, the trial of a Johnstown man charged in connection with the death of an IUP student in 2017 gets underway today.
Testimony is expected to begin at 10:00 this morning in the trial of Brady DiStefano, who is charged with aggravated assault in connection with the death of Caleb Zweig of Rockville, Maryland on February 3rd, 2017. The two were fraternity brothers at Phi Delta Theta and got into a fight in the 800 block of Wayne Avenue. Zweig later died at Indiana Regional Medical Center. After charges of criminal homicide and aggravated assault were filed against DiStefano, the charges were dismissed by then-Indiana County President Judge William Martin due to a lack of evidence. State Superior court overturned the ruling on the charge of aggravated assault. Later on, Martin ruled that the jury could not hear evidence that DiStefano’s role in the fight lead to Zweig’s death and that the jury could not hear testimony from a forensic pathologist who performed the autopsy. Those rulings were also overturned by State Superior Court.
DiStefano’s trial has been delayed in the court system six times before.
