According to prosecutors, Mincy stormed into Malizia’s law office in Emporium, about 105 miles southeast of Erie. She was upset about a property transfer he handled as a private practice lawyer, not as district attorney.

Both sides agreed that Mincy then bit Malizia and shot him in the leg with a .25 caliber automatic handgun. Mincy drove away from the scene but was arrested shortly afterward .
Malizia was treated at a local hospital that night and was back at work the next day.
According to Malizia, Mincy was upset about which names were on a deed when property ownership was transferred. Malizia has continued to serve as district attorney for Cameron County , which is home to about 4,500 people.
“I commend District Attorney Malizia for his continued commitment to his community despite this traumatic assault,” said Henry , who prosecuted the case due to Malizia’s conflict of interest.
