Lawsuit in 18-year-old Toyin Amuda's drowning death dismissed

A lawsuit filed against the homeowners where a Deer Creek High School graduate drowned at a pool party has been dismissed, court records show.

Emergency responders pronounced Oluwatoyin “Toyin” Amuda, 18, dead at about 3:11 a.m. June 16, 2021, in the 21600 block of Villagio Drive in an unincorporated area west of Edmond.

Investigators with the Oklahoma County Sheriff’s Office previously said Amuda may have accidentally fallen into the water or entered on his own after consuming alcohol and marijuana. Amuda did not know how to swim, according to court filings.

Authorities also discovered two plastic garbage containers in the driveway, filled with empty beer cans and assorted liquor bottles, according to the report. In addition, investigators found two empty beer cans near a hot tub, an empty bottle of vodka and empty Jell-O packages.

The medical examiner’s office determined the manner of Amuda’s death was an “accident,” according to a summary report in August 2021.

Last December, the family of Amuda sued the homeowners in Oklahoma County District Court, citing wrongful death and negligence.

Amuda’s family accused the homeowners of permitting “unsupervised drinking by underaged persons at a birthday party in and around the swimming pool” of their residence.

The family also accused them of failing to supervise or control the birthday party around the pool. Amuda’s estate sought damages in excess of $10,000.

But in May, the lawsuit was “dismissed with prejudice,” prohibiting the case from being refiled and also indicating it may have been settled. 

Neither attorneys representing Amuda’s family nor the homeowners immediately responded to requests for comment Thursday.
