Dallas police release video of officer shooting armed suspect

Man shot, critically injured by Dallas officer charged with aggravated assault

DALLAS (CBSNewsTexas.com) — A man who was shot by a Dallas police officer over the weekend has been charged with aggravated assault on a public servant.

Dallas Police Chief Eddie Garcia held a press conference Wednesday and released bodycam footage of the incident

On Sunday, Police were alerted by property management at 1910 Bennett Avenue that a man suspected to be involved in a stolen vehicle case earlier this month was present at the location. 

Senior Corporal Matthew McLain, upon arriving at the apartments, requested backup and Officer Kimberley Esquivel joined him to search the building. 

In the back parking lot of a nearby apartment building, they spotted Hernan Gutierrez, who allegedly has a prior record of criminal mischief and burglarizing vehicles. 

The officers began engaging with Gutierrez and a struggle ensued.

Police attempted to use a taser on him, but it was not affective. Gutierrez pulled out a handgun, firing one round.

Esquivel pulled out her handgun and shot one time, hitting Gutierrez. Gutierrez fell on top of his weapon, and officers placed him in handcuffs.

Dallas Fire-Rescue took Gutierrez to a local hospital where he is in critical condition.

The round that was fired by Gutierrez hit an occupied apartment near the incident location. No one was reported injured.

In addition to the aggravated assault charge, Gutierrez is currently wanted on a federal probation violation for a firearm-related offense. DPD says additional charges are possible.

The investigation is ongoing.
