As the Supreme Court recently found the Biden Administration’s moratorium on evictions unconstitutional, one longtime civil litigator has said the ruling is most appropriate. Christopher Brandlin, a civil law attorney, said while he understands the troubles many are going through during the COVID-19 crisis, placing all the financial burdens on...

San Francisco Landlords File Lawsuit Against City Over Ordinance Allowing Unpaid Rent Forgiveness

Two San Francisco landlord groups filed a lawsuit on Wednesday against the city, challenging a city relief aimed at dismissing certain rent debt. According to the lawsuit filed in the San Francisco Superior Court, the San Francisco Apartment Association and Small Property Owners of San Francisco Institute argue that legislation passed in July by the San Francisco Board of Supervisors that relieves all back rent on small businesses that were shut down for a long time during the COVID-19 pandemic, such as salons, gyms, tattoo shops, and other similar establishments, goes too far and simply removes any unpaid rent without compensation.

St. Paul rent proposal offers predictability for renters and landlords alike

Lindeke’s argument against vacancy control is misguided at best. This November, St. Paul voters will have the chance to pass a rent stabilization policy that will lead the nation in rewriting the outdated and unfair rules that give landlords unlimited power to economically exploit their tenants. And voters need to know the facts about the necessity and impact of this vital proposal.

COVID Rent Relief: What Renters And Landlords Need to Know as California's Eviction Moratorium Ends

California's eviction moratorium — the state's protections for renters who have been unable to pay their rent — will be expiring at the end of September. This means that starting October 1st, landlords in many places in California can once again evict tenants for not paying their rent. And in order to avoid being evicted, renters who have been financially impacted by COVID-19 must pay a portion of their back-rent due and can apply for extra help from rent relief through state or local programs.

While owning a home is still considered the American dream, at least one in three homes is rented rather than owned by the occupants. Whether those rental properties are part of large apartment complexes or single-family units, both landlords and tenants have rights and responsibilities. While it’s always a good idea to consult a legal expert when questions arise, one can also keep reading for basic information or click here to find out more .

Can the Landlord Enforce Rules That Violate My Rights Under the Law?

Your landlord must provide a safe and well-maintained apartment that is habitable according to state law. Once you and your landlord have entered into an agreement for a specific period of time, they are required to uphold your contractual agreement until that date has expired. Your landlord cannot enforce the rules of tenancy unless they are consistent with the contract you both signed. If they violate any of your rights, they can get into legal trouble. You can also refuse to pay your rent until the landlord remedies the problem. There are several ways you are protected from your landlord breaking rules.

Housing authorities are offering landlord incentive programs

PRESQUE ISLE, Maine (WAGM) - Housing Authorities are offering incentives for landlords to rent to tenants with vouchers. Lisa Plourde, executive director of Caribou Housing Authority, says while local housing authorities are still providing vouchers for eligible families, the number of housing units available is not meeting the demand. Plourde says this may be because of COVID and the end of the eviction moratorium, or because more people are moving to the county. The Landlord Incentive Program, a partnership between local housing authorities and the state housing authority, hopes to address the lack of units.
