At the time, Birmingham Police Chief Scott Thurmond said the officer shot Patton after he had first tried shooting him, but bodycam footage revealed Patton did not fire at the officer .

Patton was taken to a hospital and treated for his injuries before being formally charged Sunday. The officer who shot at Patton has been placed on administrative leave.

Patton is being held at the Jefferson County Jail on $273,000 bond.
