RIGHT NOW. THE REALITY IS A MINUTE IS ALL THEY NEED AND THAT’S THAT’S THE WAY IT’S ALWAYS BEEN. A HOMELESS MAN IN ALBUQUERQUE STOLE A STATE VEHICLE THAT WAS LEFT UNATTENDED. THEN GOT INTO A CRASH, LEAVING TWO PEOPLE IN CRITICAL CONDITION. HE WAS SUPPOSED TO BE IN COURT TODAY. ACTION 7 PUT JOHN KARR NEARLY HERE WITH WHY THAT SUSPECT DIDN’T SHOW UP. YEAH, THAT’S RIGHT. SHOWING DOUG JOHN BEARDED JR WAS SET TO HAVE HIS PRETRIAL DETENTION HEARING TODAY, BUT IT GOT CANCELED TONIGHT. WE’VE OBTAINED VIDEO OF THE CRASH AND TAKE A LOOK AT HOW YOU CAN BE TICKETED IF YOU LEAVE YOUR CAR ON AN UNATTENDED. THIS WAS THE CRASH THAT HAPPENED AT SAN PEDRO DRIVE IN BEL AV AROUND 8 A.M. MONDAY MORNING. I WAS IN THE BATHROOM WHEN I HEARD IT AND I LOOKED OUT IMMEDIATELY. I SAW THE VEHICLE, YOU KNOW, LAYING ON ITS SIDE, SMOKE COMING UP FROM THE RADIATOR AND A MANUAL KILLS WITNESSED THE WRECK THAT HAS LEFT TWO PEOPLE IN CRITICAL CONDITION. THIS RED VEHICLE WAS STOLEN BY JOHN BEARDEN JR, A HOMELESS MAN WHO WAS ABLE TO STEAL THE STATE OWNED CAR BECAUSE IT WAS LEFT ON AN UNATTENDED AT EXPO. NEW MEXICO CAN ONLY IMAGINE THAT WITH THE STATE VEHICLE IT WOULD BE THAT MUCH MORE INTENSE OF A SITUATION WHERE YOU DON’T LEAVE IT UNLOCKED OR UNATTENDED. PREVIOUSLY, WE REPORTED NEW MEXICO’S ADMINISTRATIVE CODE STATES SOMEONE AUTHORIZED TO DRIVE A STATE VEHICLE MUST TURN OFF THE CAR AND LOCK BOTH THE DOORS AND THE TRUNK. NOW, WE’VE DISCOVERED THERE IS AN ORDINANCE IN ALBUQUERQUE THAT PROHIBITS ANYONE FROM LEAVING A CAR ON AN UNATTENDED. IF YOU DO THIS, YOU COULD BE TICKETED. I DON’T KNOW HOW MANY TIMES ENFORCEMENT CAREER, I HEARD THE WORDS I WAS ONLY GONE FOR A MINUTE OR A FEW A FEW MINUTES IN MY CAR IS GONE OR MY OR MY CAR IS BROKEN INTO AND SOMETHING IS TAKEN. PUBLIC SAFETY EXPERT PAUL ZECH SAYS PEOPLE SHOULD ALWAYS TURN THEIR CARS OFF AND LOCK THEM, EVEN IF IT’S COLD OUTSIDE. HE ALSO SAYS AWARENESS IS KEY TO PREVENTING ANYTHING FROM BEING STOLEN. PEOPLE NEED TO START PAYING REAL CLOSE ATTENTION TO WHO’S IN THE CARS THAT ARE SITTING PARKED AND INDIVIDUALS THAT YOU JUST GET A FEELING THAT, HEY, SOMETHING’S OFF HERE, THIS PERSON’S MAYBE IN THIS CAR FOR A REASON. THEY’RE WAITING FOR ME TO GO INSIDE AND THEN SUDDENLY THINGS ARE GONE. HOW MANY TIMES? AND BEARDEN JR WILL NOW APPEAR IN COURT ON APRIL 10TH. WE’LL UPDATE YOU ON WHETHER HE’LL BE RELEASED BEFORE HIS TRIAL. I’M JOHN CORNELY REPORTING. KOAT ACTION 7 NEWS.

Can you be ticketed for leaving car unattended in Albuquerque?
A homeless man in Albuquerque who stole a state vehicle that was left unattended and got in a crash leaving two people in critical condition was supposed to appear in court on Thursday. John Bearden Jr. was set to have his pre-trial detention hearing Thursday morning, but it got canceled. According to police, on March 27 around 8:00 a.m. Bearden crashed a state-owned vehicle he stole into another car at San Pedro Drive and Bell Ave in Albuquerque. The two people in the other car are in critical condition. An official police report revealed Bearden was able to steal the state-owned car because it was left on and unattended at Expo New Mexico. Previously, we reported New Mexico's Administrative Code states someone authorized to drive a state vehicle must turn off the car and lock both the doors and the trunk. Now, we have discovered there is an ordinance in Albuquerque that prohibits anyone from leaving a car on and unattended, if you do this you can be ticketed. “The reality is a minute is all they need. That’s the way it's always been,” said Paul Szych, a public safety expert. Szych said people should always turn their cars off and lock them even if it's cold outside. He also said awareness is key to preventing anything from being stolen. “People need to start paying close attention to who is in the cars that are sitting parked around them. Pay attention to people you get a weird feeling from. A person may be sitting in a car for a reason. They may be waiting for you to go inside, and then you come out and your things are gone,” Szych said. Bearden will now appear in court on April 10. His public safety assessment recommends he be released.
